Why do stepparents adopt stepchildren?

On Behalf of | Jun 12, 2019 | stepparent adoption

Stepparent adoption is one of the most common types of adoption in North Carolina. If you are a stepparent, you may come to a point where you need to consider adopting your stepchildren. While this option may work for many families, it is not the best solution for every family. It is important that you consider the reasons behind the adoption to make sure that it is really the right choice for your family.

According to FamilyEducation, one of the main reasons is the legal protections a stepparent adoption offers. It allows you to have a legal right to the child. If something happens to your spouse, you can still be the child’s parent and take care of him or her. In addition, if the child’s other parent has died or is not in the child’s, it gives the child some protection and security that he or she may not otherwise have.

Adopting a stepchild ends the relationship with the non-custodial parent. For example, if your wife is the child’s biological mother and the biological father is no longer in the picture, then you could end the biological father’s rights to the child and adopt him or her. The other parent must agree to give up his or her rights or a court must make the ruling before you can adopt.

If your stepchild has a good relationship with his or her other parent, then adoption is probably not going to work. First, removing the other parent’s rights would probably not work to allow for the adoption. Second, the child probably would not want to end the relationship with the other parent. This information is for education and is not legal advice.
